Seafood importers in the US must verify that their suppliers follow seafood HACCP rules. A new FDA warning letter to a New York importer shows what happens when they do not. On 20 August 2026, the US Food and Drug Administration (FDA) warned South Asian Food Inc. in Maspeth, New York. The letter cites serious violations of the seafood HACCP regulation, 21 CFR Part 123. For Vietnamese exporters, the case shows what US importers must check before they accept seafood.

FDA Warning Letter Timeline: From Inspection to Response Deadline
According to the FDA, its investigator inspected the importer’s facility for one week in March 2026. Then, the warning letter followed more than five months later.
| Event | Date |
|---|---|
| FDA inspection of the Maspeth facility | 2 to 9 March 2026 |
| Warning letter issued | 20 August 2026 |
| Deadline for the company’s written response | 15 working days after receipt of the letter |
In addition, the letter names three ready to eat (RTE) dried seafood products, all vacuum packed:
- Anchovy with Chilli
- Lotia Bombay Duck with Chilli
- Golden Dried Shrimp with Chilli, Garlic and Onion
Seafood HACCP Violation 1: No Written Importer Verification
To begin with, the first violation concerns 21 CFR 123.12, the seafood HACCP rule for imported fish and fishery products. Specifically, the FDA found that the importer had no written verification procedures with affirmative steps for its RTE products. Moreover, these products carry a Clostridium botulinum hazard. Yet they were stored at ambient temperature, and their labels gave contradictory storage instructions.
Violation 2: Pests and Open Doors in the Warehouse
Next, the second violation falls under the food safety rules in 21 CFR Part 117, Subpart B. The FDA investigator reported that “a cat was observed roaming between rows of pallets containing food”. Furthermore, cat food, cat litter and a litter box were found in the warehouse. In addition, the warehouse doors were kept open, and their damaged curtains could not keep pests out.
As a result, the FDA considers the imported dried seafood adulterated. In its words, the products were “prepared, packed or held under insanitary conditions whereby they may have been rendered injurious to health”. If the violations are not corrected, the FDA may refuse admission of the company’s imported seafood, place products on detention, or seize them.
Seafood HACCP Rules for US Importers: What 21 CFR 123.12 Requires
Under 21 CFR 123.12, every US importer of fish or fishery products has two options. First, it can buy from a country that has an active equivalence agreement (MOU) with the FDA. Otherwise, it must keep written verification procedures with product specifications and affirmative steps. The rule lists these affirmative steps:
| Affirmative step under 21 CFR 123.12 | What the importer needs |
|---|---|
| A. Processor records | HACCP and sanitation monitoring records for the specific lot |
| B. Certificate | A continuing or lot by lot certificate from a foreign government inspection authority or a competent third party |
| C. Facility inspection | Regular inspections of the foreign processor’s facilities |
| D. HACCP plan and guarantee | An English copy of the processor’s HACCP plan and a written guarantee |
| E. Product testing | Periodic testing of the imported product and an English written guarantee |
| F. Other measures | Other checks that give an equivalent level of assurance |
In addition, the importer must keep English records of every affirmative step it performs. Notably, most of these steps rely on records or guarantees from the foreign processor. Therefore, US buyers request them from exporters.
What Should Vietnamese Seafood Exporters Do?
ISOLUTION LOGISTICS JSC recommends these seafood HACCP steps before shipping to the US:
- First, keep an up to date English copy of your HACCP plan, ready to share with US importers.
- Then, prepare HACCP and sanitation monitoring records for each lot, because importers may ask for them.
- Also, ask your buyer early which affirmative step they use: a certificate, a factory inspection or product testing.
- In addition, check that storage instructions on labels match how the product must really be kept.
- Finally, for frozen or chilled seafood, protect the cold chain with reefer containers and keep temperature records from factory to US port.

In short, seafood HACCP checks now reach from US warehouses back to exporters in Vietnam. As a result, exporters who prepare documents early and ship with a partner who controls the cold chain are better placed to avoid problems at the US border.
Thư nêu tên ba sản phẩm hải sản khô ăn liền (RTE), đều đóng gói chân không: cá cơm tẩm ớt (Anchovy with Chilli), cá khoai tẩm ớt (Lotia Bombay Duck with Chilli) và tôm khô tẩm ớt, tỏi, hành (Golden Dried Shrimp with Chilli, Garlic and Onion).

(Golden Dried Shrimp with Chilli, Garlic and Onion)。
🧭 ISOLUTION LOGISTICS
